1. Introduction and Acceptance

Welcome to Approach App, a coaching platform developed by Triumph Joe. These Terms of Service ("Terms") govern your use of our mobile application and related services (collectively, the "Platform").

By accessing or using our Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Platform.

Definitions

• "Platform" refers to the Approach App mobile application and all related services
• "Services" refers to all features, content, and functionality provided through the Platform
• "Users" refers to all individuals who access or use the Platform
• "Coaches" refers to users who provide coaching services through the Platform
• "Clients" refers to users who receive coaching services through the Platform
• "Content" refers to all text, images, videos, audio, and other materials on the Platform

2. Eligibility and Account Requirements

Age Restriction

You must be at least 18 years old to use our Platform. By using our Services, you represent and warrant that you are at least 18 years of age. We do not knowingly collect information from or provide services to individuals under 18.

Account Creation

To access certain features of our Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

3. Platform Services and Usage

Service Description

Approach App provides a comprehensive coaching platform featuring:

• Communication Tools: Direct messaging and group features
• Smart Journaling: Progress tracking and reflection tools
• Daily Inspirations: Motivational content delivery

You agree to use our Platform only for lawful purposes and in accordance with these Terms. You will not:

4. Subscription and Payment Terms

Payment Processing

All payments are processed exclusively through Apple Store In-App Payments. We do not store or have access to your payment information. All transactions are subject to Apple's terms and conditions.

Subscription Plans

• Monthly subscriptions with automatic renewal
• Annual subscriptions with automatic renewal
• Coach-specific subscription tiers
• Client access subscriptions

Auto-Renewal and Cancellation

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions through your Apple App Store account settings.

Refunds

Refund requests are handled according to Apple's App Store refund policy. We do not process refunds directly. Contact Apple Support for refund requests.

Price Changes

We reserve the right to modify subscription prices with at least 30 days' notice. Price changes will not affect existing subscriptions until renewal.

5. Content and Intellectual Property

Platform Content

All content provided by Approach App, including but not limited to text, graphics, logos, software, and functionality, is owned by us or our licensors and protected by intellectual property laws.

User-Generated Content

You retain ownership of content you create and share on the Platform. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Platform.

Coach Content

Coaches retain intellectual property rights to their original coaching materials. However, content shared through the Platform may be subject to our content guidelines and moderation policies.

Content Guidelines

All content must be:

• Appropriate for an adult audience
• Respectful and professional
• Accurate and not misleading
• Compliant with applicable laws
• Free from harmful or offensive material

6. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Communication Monitoring

We may monitor communications on the Platform for safety, quality assurance, and compliance purposes. This monitoring helps us maintain a safe environment and improve our services.

Data Rights

You have rights regarding your personal data, including access, correction, deletion, and portability, as described in our Privacy Policy and applicable privacy laws.

7. Coach-Client Relationships

Platform Role

Approach App serves as a facilitator and technology platform. We do not provide coaching services directly and are not responsible for the quality, effectiveness, or outcomes of coaching relationships formed through our Platform.

Coach Responsibilities

Coaches using our Platform agree to:

• Maintain professional standards and ethical conduct
• Provide services as described and agreed upon
• Respect client confidentiality and privacy
• Comply with applicable professional regulations
• Set realistic expectations for coaching outcomes

Client Expectations

Clients should understand that:

• Coaching results are not guaranteed
• Success depends on active participation and commitment
• Coaches are independent service providers
• The Platform facilitates but does not guarantee coaching quality

8. Safety and Community Standards

We are committed to maintaining a safe environment for all users. Our safety measures are detailed in our Child Safety Policy.

Zero Tolerance Policy

We maintain zero tolerance for:

• Child sexual abuse and exploitation (CSAE)
• Harassment, bullying, or threatening behavior
• Discrimination based on protected characteristics
• Sharing of illegal or harmful content

Users can report violations through:

• In-app reporting features

• Direct contact with our support team

9. Third-Party Services and Integrations

Our Platform may integrate with third-party services, including:

• Apple App Store and payment processing
• Google Analytics and Firebase Analytics
• Other approved service providers

Use of third-party services is subject to their respective terms and conditions. We are not responsible for third-party service availability or performance.

10. Legal Compliance and Jurisdiction

Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction where Triumph Joe operates, without regard to conflict of law principles.

Regulatory Compliance

We comply with applicable privacy and consumer protection laws, including:

• CCPA/CPRA: California Consumer Privacy Act and California Privacy Rights Act
• GDPR: General Data Protection Regulation (European Union)
• CalOPPA: California Online Privacy Protection Act
• FOSTA-SESTA: Federal anti-trafficking legislation

Dispute Resolution

Any disputes arising from these Terms will be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class action lawsuits.

11. Limitation of Liability and Disclaimers

Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. The Platform is provided "as is" without warranties of any kind.

Coaching Results

We make no guarantees about coaching effectiveness or specific outcomes. Results depend on individual effort, circumstances, and other factors beyond our control.

Liability Limitations

To the maximum extent permitted by law, our liability is limited to the amount you paid for the Platform in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold us harmless from claims arising from your use of the Platform, violation of these Terms, or infringement of third-party rights.

12. Termination and Account Closure

User Termination

You may terminate your account at any time by contacting us at joe@approach-coach.com or through in-app settings.

Platform Termination

We may suspend or terminate accounts for:

• Violation of these Terms
• Illegal or harmful activity
• Non-payment of subscription fees
• Extended inactivity

Effect of Termination

Upon termination:

• Your access to the Platform will cease
• Subscription charges will stop (subject to Apple's policies)
• Your data may be retained as described in our Privacy Policy
• Certain provisions of these Terms will survive termination

13. Updates and Communication

Terms Updates

We may update these Terms periodically. Material changes will be communicated through:

Continued use of the Platform after changes constitutes acceptance of updated Terms.

Platform Updates

We regularly update the Platform to improve functionality, security, and user experience. Some updates may require acceptance of revised Terms.

Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.
